永住権申請には？ Subclass 880 Updated

Skilled–Independent Overseas Student (subclass 880）について

「オーストラリアの教育機関で2年間以上のフルタイムの教育を受け、degree, diploma , trade qualificationの資格を
　取得した学生が、卒業後6ヶ月以内に申請する事が出来る永住権のカテゴリー」

改訂版

2003年12月シドニーに訪問して、色々なエージェントと話をし最終的に、
ビジネスビザをスポンサーしてもらい渡豪すると言う計画を断念、
2004年後半に留学を開始という、大きく方向転換する事を決断
シドニーより、SUMINに電話で告げる。
(この最初の段階で、SUMINから同意が獲られなければ、止めようと思ったが、意外にすんなりo.k.だった）

その後、2004年4月に、永住権申請ポイントが115点から、120点にUPするニュースが飛び込む
当初の予定していた学校では、120点まで行かないので、アデレードの学校にtargetを変更する。

2005年1月、2年間のTAFE(州立専門学校）で、cookeryの勉強後、
2007年初頭に、「サブクラス880　新卒独立永住ビザ」を申請する事を目標に渡豪
現在、2年目のコースを取得中

このカテゴリーでの永住権の申請には、2006年5月現在、以下の条件がある

・年齢　　　　　　　　　45歳以下であること

・英語能力　　　　　　オーストラリアで働く為の充分な英語能力　(IELTS English Testで証明）

・資格　　　　　　　　　申請した職業において、評価機関より技術査定・認定されている事　(skill assessmenｔ)
　　　　　　　　　　　　　　2005年7月より、cookとして新卒独立永住ビザ用の技術査定を受ける場合、900時間の実務経験が必要になる。
　　　　　　　　　　　　　　sub class 880の場合、60 pointの職業である事　（博士号の場合は50 pointでも可)

・職業　　　　　　　　　申請した職業がオーストラリアで必要としている職業リスト（Skilled Occupation List ・ SOL)にのっている事

・職歴　　　　　　　　　職業によって変ってくるが、申請直前に2～3年の経験が必要
　　　　　　　　　　　　　　（評価機関に査定・認定を受けるには、5～7年くらいの職歴が必要らしい）
　　　　　　　　　　　　　　sub class880では、職歴に関しては免除される

・ポイントテスト　　　120 point以上をマークしている事

POINT TEST

ポイントテストとは、どのようなものか?
以下が、移民局に出ているpoint testの要約だ
項目毎に、該当すれば点数がもらえるようになっていて、合計pointが120点に到達すれば、永住権が申請できる仕組みだ。
KAPPAがどのpointを取るのか、simulationもあわせてやってみたいと思う。

　　現在、調理の学校に行って卒業後、skill assessmentを合格すれば、現在の所、60 pointで申請が出来る予定

Points for age

　　申請する2007年初頭は、33歳なので、25 pointがもらえる予定

Points for English language ability

English language ability	Points

Vocational English - a reasonable command of the English language, coping with overall meaning in most situations and the ability to communicate effectively in nominated field of employment.	15

　　IELTSのtestで、全項目（reading・Writing・Listening・Speaking）で、6点以上をマークする
　　現在の所、Writing等が、下回っているので、2年間のうちにmaster予定　ここでは20 point

　英語力に関して、近々変更の予定があると言うニュースがあり
　2006年5月現在　変更の詳細・施工時期は未定

Points for specific work experience

　　今回、申請予定の調理師では、職務経験がないので、point算定できない。よって0 point

Points for occupation in demand/job offer

A number of occupations/specialisations have been identified as being in demand in Australia.
They are listed on the Migration Occupations in Demand List (MODL).

　　2005年5月だったかな？　MODLリストに、Cookが復活
　　Chefだけでなく、Cookもリストにのったので、15ポイント算定できる事に
　　ただ、これは、いつリストから消えるかわからない点、申請時でなく、査定時にリストに無いといけない点を
　　考慮すると、非常に不確定の要素
　　Cookが、大量にオーストラリアに押し寄せているだけに、いつまで残ってくれるか不安です・・・

Points for Australian qualifications

Applicants with Australian qualifications have a greater chance of employment in Australia.
Points may be awarded for only one of the following Australian qualifications completed
　whilst present in Australia and where all the instruction was in English:

You have completed an Australian doctorate at an Australian educational institution after a period of at least 2 years full time (2 academic years) while in Australia	15
You have completed an Australian Masters or Honours degree (at least upper second class level) at an Australian educational institution while in Australia, and prior to completing the Masters or Honours degree, 　you were awarded an Australian bachelor degree as a result of at least 1 year full time study while in Australia. 　　今回、2年間学校に行き、Diplomaの資格までは取る予定なので、5 pointもらえる。

Points for regional Australia/low population growth metropolitan areas

Applicants who can claim points for Australian qualifications may also be eligible to claim points
for having lived and studied for at least 2 years in regional Australia or low population growth metropolitan areas.

　　今回、アデレードという都市に留学をする事となった、もっとも大きな理由がこのpoint　アデレードの2年間の学生生活で 5 point算定予定

Points for spouse skills

Points may be awarded if your spouse if they are also able to satisfy the basic requirements of age, English language ability,
qualifications, nominated occupation and recent work experience and has obtained a suitable skills assessment
from the relevant assessing authority for their nominated occupation.

　　配偶者の技能に対してもらえる pointだが、仕事の経験が過去2,3年と絞られると、ちょっと厳しい　よって　0 point

Bonus points

Points may be awarded for one only of the following:

・Capital investment in Australia (a minimum of A$100,000); or

・Australian work experience (an applicant must have legally worked in Australia in any occupation
　on the Skilled Occupations List for at least 6 months in the 4 years before lodging an application); or

・Fluency in one of Australia's community languages (other than English)

　　community languageの１つに日本語がはいっいて日本の大学を卒業しているので、ここで 5 point追加

以上が、point testの内訳である。

こうなると、合計点数が

合計　135点で、ボーダーの120点を越え、永住権申請が出来るようになる。

ただし、このpoint testや合格ライン等は、ころころ変わっている。
自分がオーストラリア移住に興味を持ち調べ始めた2001年頃は、point testの合格pointは110点だった。
それが、115点になり、2005年4月からは120点になった。

又、通学期間も当初は、1年以上だったのが、今は2年以上になっている。
段々とハードルが高くなっているのだ。移民が増えているので、ハードルを高くしてより質が高い人間を取ろうとしているのだ。
当然といえば、当然だが、これ以上、ハードルがあがると、自分にとっても、厳しい状況である。

ただ、これは、日本を旅立つ前から分かっていた。政権、オーストラリア経済の状況、世界経済色々な外的要因も
移民法に少なからず影響するから、今後どう変更されていくか？わからない。
もしかしたら、さらにハードルがあがったり、pointの算定方法が変わったりするかもしれない。

だから、今の移民法が変わらなければ、永住権が取れる予定だが、移民法が改正すると場合によっては、
今の方向性を変えなくてはいけない場合もある。

けど、そのriskにおびえて、「決断しない」あるいは、「決断を先延ばしにする」というのだけは、したくなかった。
「このriskは回避しようがない」と判断し、むしろ、「No Risk , No Return」人生の勝負時である。
ここで、決断して進むことは、結果がどうなるであれ、自分の人生経験の大きくプラスになると思ったのだ。

移民法の先行きは気になるが、今は、一生懸命料理学校で学び、永住権をとった後、
実際にオーストラリアの料理界でやっていける技術をつけたい。
